1. Acceptance of Terms

By accessing or using MySPF ("My Student Provider Finder"), a service operated by Digital Provider Services LLC, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this site.

BY USING THIS SERVICE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO ALL OF THESE TERMS, DO NOT USE THIS SERVICE. YOUR USE OF THIS SERVICE CONSTITUTES YOUR ACCEPTANCE OF THESE TERMS AND YOUR AGREEMENT TO BE LEGALLY BOUND BY THEM.

2. Eligibility and Age Requirements (COPPA Compliance)

You must be at least 13 years old to use this service. This requirement is mandated by the Children's Online Privacy Protection Act (COPPA). By using MySPF, you represent and warrant that:

  • You are at least 13 years of age
  • You have the legal capacity to enter into this agreement
  • You have not been previously suspended or removed from our service
  • If you are under 18, you have parental or guardian consent to use this service

Children Under 13

We do not knowingly collect or solicit personal information from children under 13. If we learn that we have collected personal information from a child under 13 without parental consent, we will delete that information as quickly as possible. If you believe that a child under 13 may have provided us with personal information, please contact us immediately at ADMIN@digitalproviderservices.com.

3. Geographic Restrictions

MySPF is intended for use only by residents of the United States. By using this service, you represent and warrant that:

  • You are located in the United States
  • You are accessing the service from within the United States
  • You will not use VPNs, proxies, or other methods to circumvent geographic restrictions

Users attempting to access the service from outside the United States may be blocked. Any attempt to circumvent geographic restrictions is a violation of these Terms and may result in immediate account termination.

4. Description of Service

MySPF is an independent directory service that helps families find education service providers for their students. Providers who accept Florida scholarship funds (such as Step Up) can self-identify as "StepUp Direct" providers. We provide a platform for providers to list their services and for users to search, review, and connect with providers.

Important Disclaimer

SPF is not affiliated with, endorsed by, or representing Step Up For Students or any scholarship organization. We do not verify provider credentials, licensing, insurance, or eligibility for scholarship programs. Users should independently verify all provider information.

5. Community-Submitted Providers

MySPF allows community members to submit provider listings. These "Community Registered" providers are distinguished from self-registered providers. You acknowledge and agree that:

  • Community-submitted information may not be accurate or current
  • These listings are not verified or endorsed by MySPF
  • The actual provider may not be aware of their listing on our platform
  • You must independently verify all information before engaging with any provider

Businesses can claim their listing through our verification process. Users can also submit disputes or request removal of inaccurate listings.

6. User Accounts

To access certain features, you must register for an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your password and account
  • Notify us immediately of any unauthorized access
  • Accept responsibility for all activities under your account
  • Not share your account credentials with others
  • Not create multiple accounts to circumvent restrictions or bans

We reserve the right to suspend or terminate accounts that violate these terms.

7. Prohibited Conduct and Circumvention

When using our services, you agree not to:

  • Post false, misleading, or defamatory content
  • Harass, abuse, or threaten other users
  • Impersonate any person or entity
  • Submit fake reviews or manipulate ratings
  • Use automated systems to access the service (scraping, bots)
  • Attempt to gain unauthorized access to our systems
  • Interfere with the proper functioning of the service
  • Use the service for any illegal purpose
  • Share sensitive personal information (SSN, financial data, health records) in messages or reviews
  • Post content containing hate speech, profanity, threats, or discriminatory language
  • Circumvent or attempt to circumvent any security measures, access restrictions, or technical limitations
  • Use VPNs, proxies, or other tools to mask your location or identity
  • Create multiple accounts to evade bans, suspensions, or restrictions

⚠️ Consequences of Violation

Violation of these terms may result in: immediate account termination without refund; permanent ban from the service; legal action including civil lawsuits and criminal referrals where applicable; reporting to relevant authorities; and liability for any damages caused by your actions.

8. User Content and Responsibility

You are solely responsible for all content you post, submit, or transmit through our service. By submitting content, you acknowledge and agree that:

  • You are the owner of the content or have the right to share it
  • Your content does not violate any third party's rights
  • You are fully responsible for any consequences of sharing your content
  • MySPF is not responsible for any misuse, disclosure, or breach of your content
  • You have no expectation of privacy for content shared on public areas of the service

⚠️ SENSITIVE INFORMATION WARNING

NEVER share Social Security Numbers, credit card numbers, bank account information, health records, driver's license numbers, or other sensitive personal information through our messaging, review, or any other feature. YOU ARE SOLELY RESPONSIBLE FOR ANY INFORMATION YOU CHOOSE TO SHARE. MySPF IS NOT LIABLE FOR ANY DAMAGES, LOSSES, OR HARM RESULTING FROM YOUR DISCLOSURE OF SENSITIVE INFORMATION.

9. Provider Listings

Providers who create listings on SPF agree to:

  • Provide accurate and truthful information about their services
  • Keep their listing information current and up-to-date
  • Only claim "Step Up Direct" status if they genuinely offer streamlined enrollment
  • Not misrepresent their credentials, licensing, or insurance status
  • Respond professionally to user inquiries and reviews
  • Comply with all applicable laws and regulations

We reserve the right to remove or modify listings that violate these terms or that we determine, in our sole discretion, are inaccurate or misleading.

10. Reviews and Community Verification

Users may submit reviews and participate in community verification of providers. By submitting content, you:

  • Grant us a non-exclusive license to display and use your content
  • Confirm that your review reflects your genuine experience
  • Agree not to accept payment in exchange for reviews
  • Understand that we may remove content that violates our policies

Community verification badges indicate that verified users have confirmed a business. This is not a guarantee of quality, licensing, or legitimacy.

11. Premium Services

We may offer premium subscription services with additional features. Premium subscriptions are subject to the following:

  • Fees will be clearly disclosed before purchase
  • Subscriptions may renew automatically unless cancelled
  • Refunds are subject to our refund policy
  • We reserve the right to modify premium features and pricing

12. Account Deletion and Data Rights

You have the right to request deletion of your account and associated personal data. Upon account deletion:

  • Your personal information will be removed or anonymized
  • Provider profiles you own will be anonymized
  • You will lose access to any premium features or subscriptions without refund
  • Certain data may be retained as required by law or for legitimate business purposes
  • Content you've posted may remain on the service in anonymized form

13. Intellectual Property

The SPF service, including its original content, features, and functionality, is owned by SPF and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express permission.

14. DISCLAIMER OF WARRANTIES

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE EXPRESSLY DISCLAIM ALL WARRANTIES AND DO NOT WARRANT THAT:

  • The service will be uninterrupted, secure, or error-free
  • Provider information is accurate, complete, current, or reliable
  • Providers are licensed, insured, qualified, or legitimate
  • Services rendered by providers will meet your expectations or be satisfactory
  • Any information obtained through the service will be accurate
  • Defects in the service will be corrected
  • The service or servers are free of viruses or harmful components

YOU ASSUME FULL RESPONSIBILITY FOR VERIFYING PROVIDER QUALIFICATIONS, CREDENTIALS, LICENSING, INSURANCE, AND LEGITIMACY. YOU ASSUME ALL RISK FOR ANY INTERACTIONS, TRANSACTIONS, OR AGREEMENTS WITH PROVIDERS FOUND THROUGH OUR SERVICE.

15. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MYSPF, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, PARTNERS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, revenue, data, or business opportunities
  • Loss of goodwill or reputation
  • Personal injury or property damage
  • Emotional distress or mental anguish
  • Any damages arising from service interruptions or downtime
  • Any damages arising from provider conduct or misrepresentation
  • Any damages arising from community-submitted provider information
  • Any damages arising from unauthorized access to or alteration of your data
  • Any other intangible losses

REGARDLESS OF THE CAUSE OF ACTION OR THE THEORY OF LIABILITY, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, EVEN IF MYSPF HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US FOR ONE MONTH OF A PAID SUBSCRIPTION, IF ANY.

16. ASSUMPTION OF RISK

BY USING THIS SERVICE, YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT:

  • You use this service entirely at your own risk
  • You are solely responsible for evaluating and verifying any providers
  • You are solely responsible for any agreements or transactions with providers
  • You release MySPF from all liability arising from your use of the service
  • You waive any claims against MySPF for negligence, breach of duty, or misconduct
  • You understand that provider information may be outdated, inaccurate, or fraudulent
  • You will not hold MySPF responsible for any harm caused by providers

17. Indemnification

You agree to defend, indemnify, and hold harmless MySPF, its parent company, subsidiaries, affiliates, officers, directors, employees, contractors, agents, licensors, and suppliers from and against any and all claims, damages, obligations, losses, liabilities, costs, debt, and expenses (including but not limited to attorney's fees and legal costs) arising from:

  • Your use of and access to the service
  • Your violation of these Terms
  • Your violation of any third party rights
  • Any content you submit or post
  • Any claim that your content caused damage to a third party
  • Your interactions with any providers

18. Dispute Resolution and Arbitration

Any dispute, controversy, or claim arising out of or relating to these Terms or the service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in the State of Florida, and the arbitrator's decision shall be final and binding.

Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in class action lawsuits or class-wide arbitration.

19. Feedback and Feature Requests

We welcome and encourage feedback, suggestions, ideas, and feature requests ("Feedback") from our users. However, by submitting any Feedback to SPF through any channel (including but not limited to email, forms, social media, or verbal communication), you agree to the following terms:

  • Your Feedback is provided voluntarily and without any expectation of compensation
  • SPF has no obligation to use, implement, or respond to your Feedback
  • SPF may use, modify, or implement your Feedback without any obligation to provide you with credit, attribution, or acknowledgment
  • You waive any claim to compensation, royalties, or other payment related to your Feedback
  • Your Feedback does not create any confidential or fiduciary relationship
  • SPF is not obligated to keep your Feedback confidential

By submitting Feedback, you grant SPF a perpetual, irrevocable, worldwide, royalty-free, fully transferable license to use, reproduce, modify, adapt, publish, create derivative works from, and otherwise exploit your Feedback for any purpose, without restriction or compensation to you. If you do not agree to these terms, please do not submit Feedback.

20. Termination

We may terminate or suspend your account and access to the service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination:

  • Your right to use the service will immediately cease
  • You will not receive any refunds for premium services
  • Provisions of these Terms that should survive termination will remain in effect

21. Changes to Terms

We reserve the right to modify these terms at any time. We will provide notice of material changes by posting the updated terms on this page. Your continued use of the service after changes constitutes acceptance of the modified terms.

22. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the intent of the original provision.

23. Governing Law

These terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the federal or state courts located in Florida.

24. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and MySPF regarding your use of the service and supersede all prior agreements, understandings, and communications, whether written or oral.
